    My first Ebay idiot seller

Here is the item as described. I purchased, and what follows is replies from the seller and my statements to him.

Item no. #260082335021, Gilera Gas Tank Mid 60s 96-106-124 CC Others--Nice

Up for sale is Is a very nice 1966 Gilera gas tank that I recently painted for a 124 CC SHOW restoration that I did not use. It is painted in the very hard to find original Gilera lacquer color of BURGUNDY--included is the fuel valve acd cap--tank was very nice and required only paint due to sun fading. This one should be the same as the 96-106-124CC models for the mid to late 60s-maybe others.----I also have a very nice 124-5V tank for sale as well as a barn full of parts and 2 bikes that will sell cheap--some listed and some to be listed soon

    ******
I won the item, he ships it to me.
    **********

Here is what I wrote to him after examining the tank.

Would you consider a return / refund? I just received the tank,
and I am not very happy with the paint job. Color was not
important, but the color is very uneven, there is a large amount
of a white substance inside the tank that is peeling very badly
and would need to be dealt with somehow, and upon opening
the cap, the paint was chipped away from under the lever, and it
seems as though the tank was painted with the cap in place, so
there was no paint under where the lever overhangs the cap.
Also, a minor point, it is too long by about 2 inches for my 1966
gilera. Let me know. I am happy to send it back to you via UPS.
    Scott

    Here is his reply

I think you maybe confused. The tank got a $75. creem job for presrevation purposes only as I intended to use it eventually--and creem does not chip or peel as I have lots of experience with that stuff. You are right about that $350. paint jobn in as far as people dont usually look under the release lever--and the color is supposed to change as it has a silver base. The cap was another freebe as tanks are not generally sold with them and you can replace it with a new old stock unit for $50. to $75 by merely punching out the pin--you merely don't know what you got for your money and my time because if you were trying to place it on the Gileras I advertised it as being for it would fit perfectly. If you have no alternative I wll refund 1/2 your purchase price and do an NPB agreement for ebay [so I can get part of my fees back from them] and post pos. positive feedback.. Here is what NotNickey helped me write back to him

    Richard,

I am not satisfied with the tank. It is not as described in your listing. The paint does not fit the description of a "SHOW restoration" (your words). and the "$75.00 Creem job" was incorrectly done and is deteriorating. At the end of this email there are 5 links to photos that I have posted (let me know if the links do not work; I have viewed them here and they work) to show you the poor condition of the interior of the tank. Someone threw together some "creem", splashed it into the tank, and did not finish the application procedure. At least one-half of the interior of the tank is plain steel. It is obvious from your statement "-and creem does not chip or peel " that you did not look inside the tank before selling it. Your statement, I quote, "I have lots of experience with that stuff" may be true, but if it is, it still would indicate that noone saw the interior of the tank before it was shipped. There is also a small scratch in the paint, as received, and the last photo (1048) shows this and an example, though extreme, of the type of overall poor paint application. The bubble wrap used in shipping has also left it's impression in the paint where it was in contact against the tank inside the shipping carton. I am sure that this can be buffed out, as can the orange peel and large amount of dust in the paint, but I am not going to go through that procedure at this time.

There is no reason to even get in to the issue of the cap; it is irrelevant based on these other conditions.

The very mention of a "SHOW restoration" implies quality work was done by a discriminating and experienced party. I have been restoring vintage motorcycles since 1995, and have won several awards, including best of show Norton at New England's premier bike show, Larz Anderson in Brookline, MA. When an item is not as described it is sufficient reason to justify a return.

Your offer of a 50% return of my purchase price is insulting as well as unprofessional. I will make you an offer that I consider sportsmanlike and fair: I will return the tank for a refund of my purchase price minus any ebay fee you might have paid. I do not fall for that devil's bargain regarding insincere feedback and would not consider giving positive feedback for this transaction unless I felt I was being dealt with fairly by a reasonable seller. You may prove yourself to be so by a quick and fair resolution to this matter.

Please note that due to the length of this and the html photos, I could not send this through eBay's system, which I would have liked to have done to document this transaction more completely.

    and here is his response.

I will not even open your pix because it is plain to see that you can look gift horse in the mouth because You and I both know the tank is worth more in the rough that you paid--let alone several coats of lacquer and creeme-- Tells me you do not know what the hell you are talking about--Your gripe is plain to see--the tank DON"T FIT and you want me to take up the slack when my ad clearly states "as is". If you are such an EXPERT [ ? ] as you claim please let me understand why you would buy a tank for a bike that misses the mounting bolts by 4 inches..I have a wall full of trophies obtained over the last 15 years so I don't think your phony BS will fly here--please put the tank where the sun don't shine and bother me NO MORE..RC

    *****

    That's an intelligent response, eh?

    SO I just wrote back . . . .

I do not claim to be an expert, and the fact that the tank does not fit is irrelevant. If that was the case, I would have stated so. I am more than happy to move a bracket to make it fit, if it was a "show", quality tank. I am sorry you feel this way, and that you do not wish to come to a simple, easy conclusion to this matter. If the tank is worth so much, it should be easy for you to re-sell it.

    Please re-consider.

I am sure there might be more to come

you know, you should have known it was painted with the cap in place. the picture has it that way. and even i can see in the photo the paint job is not great. however, it does say show quality. and what you got certainly, in my opinion, is not show quality. well, not show winning quality. saying show quality certainly implies a higher degree of quality than what someone would typically do in a basement. which is what that looks like. no mention of the crap inside. which is just wrong. you gotta be real careful buying stuff on ebay now. there is so much crap out there. its tough to get a piece of crap like that when you were expecting something real nice. ya shoulda kept your mouth shut about it not fitting. but just being honest is a good policy.

    good luck

    sucks

you could always just start emailing everone who bids on his stuff. thats always fun.

The seller is a douchebag, report him to ebay for item not as described. Even if you take the negative feedback hit so what, they could concieveably lock his account for being a douchebag.

that pic with the two color paints (he screwed up bigtime), that is just sloppy work.

oh man, just reading this thing made my blood BOIL! i want to set up an account just to send messages to everyone who bids on his items to warn them and tell them to "withdraw their bid".....

i'm building a motorized stretched out schwinn so i parted out the original schwinn parts including the seat. i put everything on ebay and the dude who bought the seat (for a grand total of $18, but it's a matter of principle) was in california. he got it sent to his business. 4 weeks later he emails me and says that he wants a refund because he did not get the seat and that he has already contacted ebay. i tell ebay the shipping number from the usps and i ask the guy why he waited so long to even contact me. now, i dont have a problem with homosexuals, i have friends who like same sex people, you can be gay all you want, but why, gay or not, do you have to be such a fucking bitch? anyway, that's what i now think of egay because they sided with the douchefuck eventhough i showed proof of shipping. fucking pieces of fucking shit ass fucking cocksucking cunts! <- i would like to appologize for these insults to anyone who takes it personally. if you work for ebay, quit.

This is the major problem with EBay, and they admit it. I saw an interview of the CEO of EBay on some finance show. They were asking him about EBay being a market place for stolen goods. He basically agreed, saying that EBay relies on trust. With the amount of dickheads in the world, its only a matter of time before you run into one on EBay.

Sorry to hear you guys got screwed.

And yeah, that's the worst coating job I've ever seen. Looks like they just dumped it in and let it sit.

Dude....you got hosed. BUT...look at the guys feedback...I NEVER bid on anything with a seller with less than 99% positive. I also always check through the feedback responses....even ONE rude or smart ass reply to feedback and I won't bid. And I NEVER bid on anything where a guy uses any broken English in descriptions or feedback responses. On tanks I always ask for more pictures...both sides, inside etc. Always beware of someone posting only one picture of an item, you can be assured it's the best side. When you sell you get two pictures for free...if only one is used there is a reason for it.

Yeah the guy is a douche, but I would have never bid on it in the first place ( I also never bid on repainted anything).

If you want your money back I'd do the whole complaint process at ebay, even if you don't get your money you will make life a pain for this guy. As for you getting negative feedback in return...when I look at feedback I often go check the feedback of who left it...so if you had neg from a douche like this I'd discount it as a "douche negative".

If the guy gave a shit, and knew he was selling a decent part he would take it back no problem....cause he could probably get more for it in the next auction. He knows the tank is crap and he doesn't want it back.
